REGULATION ON THE PROCESSING OF PERSONAL DATA HAVING REGARD TO ARTICLES 13-14 OF THE GDPR 2016/679

According to the Regulation, Personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject, in order to safeguard the rights and freedom of the data subject.  

The controller of the data is the company SIMACO ELETTROMECCANICA s.r.l. with headquarters in S.S.235, n.16 -26834 Corte Palasio (LO) – ITALY, PI 00897170155, email info@simacosrl.it, as per article n. 4 section 1 n. 7), of EU Reg. 2016/679.

Type of processed data  

The personal data supplied shall be subject to the following:

• commercial activity of the company;
• management of receipts and credit collection;
• forwarding of commercial information concerning the business;
• ordinary accounting and VAT management for invoice issuing and credit notes;
• compliance with the obligations laid down by the law, regulations, community regulations, civil and tax regulations,
• contract management,
• possible professional external collaborations in compliance with the law,
• safeguarding of contractual rights,
• anti-money laundering legislation.

Data voluntarily supplied by data subject

The voluntary consent to the processing of personal data for commercial purposes or the optional, explicit and voluntary forwarding of communications in any form, also via email to the addresses of the company, entails the subsequent acquisition of the sender’s address, needed to answer requests, as well as any other personal data entered in the communication.

Navigation data

The computer systems and software procedures used to operate this web site acquire, during ordinary operations, certain personal data whose transmission is implicit in the use of internet communication protocols.

This is information that is not collected to be associated with identified data subjects, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.

Methods of data processing:

The processing of personal data is carried out both on paper and/or computer and automated tools based on organizational and processing logics related to the purpose of the data processing itself and in compliance with the laws in force in particular regarding confidentiality, integrity and security of the data itself in accordance with the organizational, physical and logic laid down by the regulations in force.

The controller implements proper safety measures to prevent unauthorized access to personal data, the disclosure, modification and destruction of the data.

Besides the controller, also other subjects of our structure (accounting personnel, administrative personnel, software and hardware service suppliers) may have access to the data, also sensitive data. All personnel work in compliance with the requirements laid down by  GDPR 679/2016.

All personal data, including “sensitive” data, can be communicated, as laid down by the laws in force, also in compliance with all obligations set forth by law, to all subjects entitled to receive this data and/or responsible for the tax and accounting/administrative control of the data, such as the Revenue Agency, Tax Collection Agency, Land Registry, INAIL (national institute for insurance against accidents at work), INPS (national institute of social insurance) and other insurance institutes, Companies registration Office, Municipalities and other Local Bodies, Banks, Chamber of Commerce, Institutions, professionals, agents and third parties who need to receive communication of the data to carry out the task granted to the controller of the data (for example notaries, attorneys etc. ….).

All the data that is processed can be disclosed for the filing/saving/management of the service also through clouding services to external parties appointed, if necessary, as subjects responsible for the data processing operations on behalf of the controller and who operate in compliance with the requirements of the new Regulations  – GDPR.

In order to safeguard the interests of the data subject, personal data may be communicated to credit collection and/or legal protection structures.

It is possible to ask for the list, which may be different for each client and for each task as per article n. 4 section c)

• All data processing operations are carried out in compliance with the methods laid down in articles n. 6 and n. 32 of  the GDPR and through the implementation of the proper data protection measures.  
• When the data subject is younger than 16 years of age, the processing of the data shall be lawful if and to the extent that consent is given or authorized by the holder of parental responsibility over the child, provided all identification data and copy of documents are given.
• Communication: your personal data shall be communicated exclusively to competent subjects duly authorized to carry out the services required for the proper handling of the business relation, with protection of the subject’s interests.   
• All personal data shall be processed only by agents authorized by the Controller, and may be communicated to third parties appointed as agents responsible for the processing of the data.
• Disclosure: your personal data shall not be disclosed in any way.
• Storage period: in compliance with the principles of lawfulness,  purpose limitation and data minimization, according to article n. 5 of the GDPR, the storage period of all personal data  is: 5 years after the end of the processing operations unless a longer period is agreed upon to fulfill other requirements and obligations.

The data subject can, in any moment, in accordance with the EU Regulation 2016/679 (Articles n. 15, 16, 17, 18, 19, 20, 21, 22 – Rights of the data subject), exercise the following rights:

Right of access to personal data; right to erasure or cancellation of the data or right to restriction of processing; right to object; right to data portability, right to rectification, where foreseen (the right to rectification does not affect the lawfulness of processing based on consent before its withdrawal); the right to lodge a complaint with a supervisory authority. Specifically:

A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.

A data subject shall have the right to be informed:

• of the source of personal data;
• of the purposes and methods of the processing;
• of the logic applied to the processing, if the latter is carried out with the help of electronic means;
• of the identification data concerning data controller, data processors and the representative designated as per Section 5 (2);
• of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.

A data subject shall have the right to obtain:

• updating, rectification or, where interested therein, integration of the data;
• erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
• certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;
• portability of data.

A data subject shall have the right to object, in whole or in part:

• on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
• the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
• The data subject can exercises his/her rights, as per article 12, by sending the data controller a registered letter with return receipt.
